Terms and Conditions

§ 1 Scope
These terms and conditions apply to all online purchases made by consumers at Bellona Cashmere & Horn GmbH, Richard-Wagner-Weg 40, 64287 Darmstadt (hereinafter referred to as Bellona). A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their independent professional activity.

§ 2 Conclusion of contract, storage of the contract text, detection and correction of input errors
(1) The presentations in this online shop, other online offers, brochures, circulars, price lists and other product presentations do not, in principle, constitute a binding offer to conclude a contract, unless the specific circumstances indicate otherwise.

(2) You can submit a binding offer to conclude a purchase agreement via our online shop. This is done by selecting a product for order by clicking the [Add to Cart] button and then clicking the [Checkout] button. After entering your address and payment method, you have the opportunity at the end of the ordering process, under the "Review and Order" tab, to review all entries and make any necessary changes. Changes can be made by clicking the "edit" link next to the respective entry, by deleting the ordered item from the shopping cart (trash can icon), or by changing the quantity of ordered items (drop-down menu). By clicking the [Place Order] button, you then submit a binding purchase offer.

(3) Your order and the order details you entered will be saved in your personal customer account, provided you register as a customer before or during the ordering process. Using the login details you choose during your initial registration, you will then have access to your customer account at any time and can print your order with all the entered data. The order can also be printed directly from the confirmation page after you complete your order.

(4) The order confirmation automatically sent after you submit your order merely documents that your offer has been received by Bellona, ​​but does not yet constitute acceptance of your offer.

(5) Bellona may accept your offer by sending an order confirmation in text form, i.e. in a manner suitable for permanent reproduction in characters, or by delivering the goods within 3 days of receiving the offer.

(6) The contract can be concluded in German.

§ 3 Payment
The buyer makes payment in advance via credit card, PayPal or after receiving the goods via bank transfer.

Note regarding purchases on account: For the purpose of deciding on the establishment, execution or termination of the contractual relationship, we collect or use probability values, in the calculation of which address data is included, among other things.

§ 4 Payment Default
If you default on payment, Bellona is entitled to charge default interest at a rate of 5 percentage points above the base interest rate of the European Central Bank per year. If Bellona can prove that it has incurred higher damages due to the default, Bellona is entitled to claim these damages.

§ 5 Delivery
(1) Delivery will be made to the delivery address you have provided.

(2) Unless otherwise stated, the delivery time is approximately 1-4 days from the conclusion of the contract.

§ 6 Right of withdrawal
Consumers have the following right of withdrawal if the contract was concluded exclusively using means of distance communication:

Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods.

You may use the attached model withdrawal form, but it is not obligatory.

To meet the cancellation deadline, it is sufficient that you send your notification of exercising your right of cancellation before the cancellation period expires.

Consequences of the revocation
If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (excluding any additional costs incurred if you chose a delivery method other than our cheapest standard delivery option), without undue delay and no later than fourteen days from the day on which we received your notification of withdrawal. For this reimbursement, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged any fees as a result of this reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the fourteen-day period has expired. You bear the direct costs of returning the goods. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

§ 7 Retention of Title

Until all outstanding claims against you arising from the purchase agreement have been settled in full, the delivered goods remain the property of Bellona. As long as this retention of title exists, you may neither resell nor otherwise dispose of the goods.

§ 8 Rights in case of defects / Liability for defects
The statutory regulations regarding liability for defects apply.

§ 9 Contract language, applicable law
The contract language is German. The contract concluded between you and Bellona is subject to the law of the Federal Republic of Germany.

§ 10 Jurisdiction, Online Dispute Resolution / Consumer Dispute Resolution
(1) If you do not have a residence in the Federal Republic of Germany at the time of placing the order, or if you move your residence abroad after conclusion of the contract, or if your residence is unknown at the time the action is brought, the exclusive place of jurisdiction for all disputes arising from and in connection with the contractual relationship is Frankfurt am Main.

(2) The European Commission has established an online dispute resolution platform. This platform serves as a point of contact for the out-of-court settlement of disputes concerning contractual obligations arising from online sales contracts.
